I. Rights of Disclaiming

New Jersey State Chapter, Future Business Leaders of America, Phi Beta Lambda, Inc. and all its staff, and officers (Collectively, “NJ FBLA”) reserve the right, at its sole discretion, to change, add, or remove portions of these terms of use at any time for any reason. It is your responsibility to check these terms and agree to them before using the site. Your continued usage of the NJ FBLA website is representation of your agreement with these terms. You agree that all subsequent visits will be subject to the terms of use made available at that time. These terms of use shall apply to you until the Webmaster posts a revision, at which point you must agree to the new Terms of Use (“terms”). As long as you agree to abide by these terms of use, NJ FBLA grants you (“End User”) a personal, non-exclusive, non-transferable, non-sublicensable, limited privilege to enter and use NJ FBLA’s Website and any systems of networks comprising or connected with the site (Collectively, “site”).

 

II. Purpose of Site

NJ FBLA is a Vocational School Organization created to help students learn skills necessary to attain, hold, and succeed with an occupation.

IV. Larceny of Intellectual Property, Data, and the Like

Any information taken from the website without the express written consent of the Webmaster is the responsibility of the one who does such a deed.

 

V. Warranties

Any information on the Site is not warranted as safe for your computer nor does NJ FBLA guarantee the fitness of any files. See article VII for “Fitness and Liability.”

 

VI. License

All media (downloaded or sampled), software, texts, images, graphics, user interfaces, music, videos, photographs, trademarks, logos, artwork, and other content (Collectively, “Content”), including but not limited to the design, selection, arrangement, and coordination of such content on the site is owned by or licensed to NJ FBLA and is protected by copyright, trade dress, trademark laws, and various other intellectual property laws. No part of the site and no content may be reproduced, recorded, retransmitted, sold, rented, broadcast, distributed, published, uploaded, posted, publicly displayed, altered to make new works, performed, digitized, compiled, translated, or transmitted to any other computer, website, or other medium for any commercial or non-commercial purpose without NJ FBLA or the Webmaster’s express written consent. You are not granted any rights or licenses to patents, copyrights, trade secrets, trade dress, rights of publicity, or trademarks with respect to any of the content and NJ FBLA reserves all rights not expressly granted herein.

 

VII. Fitness and Liability

NJ FBLA expressly disclaims all responsibility and liability for uses by you of any content obtained on or in connection with the site. NJ FBLA disclaims all other warranties and representations, whether express, implied, or otherwise, including the warranties of merchantability or fitness for a particular purpose. In addition, there is no warranty of non-infringement and title or quiet enjoyment. NJ FBLA will make reasonable commercial efforts to ensure that this website is made available 24 hours per day without any interruptions. However, NJ FBLA reserves the right to make this website unavailable at any time or to restrict access to all or parts of the website without notice. NJ FBLA makes no representations or warranties about sites linked to by the site or their content, nor that the links are operable. NJ FBLA does not warrant that the content is error-free of will operate without interruption. The content is not posted, intended, or licensed for use in hazardous environments requiring fail-safe controls. In no event shall NJ FBLA or its licensors or any of their officers, directors, employees, agents, members, or affiliates be liable to you or any third party for any indirect, special, incidental, punitive, cover, or consequential damages (including but not limited to damages for the inability to use equipment or access data, loss of business, loss of profits, business interruption, loss of business information, the like, or any pecuniary loss), arising out of these Terms of Use or the use of, or inability to use, the content and based on any theory of liability including breach of terms, breach of warranty, tort (including negligence), product liability or otherwise, even if NJ FBLA or its representatives have been advised of the possibility of such damages and even if a remedy set forth herein is found to have failed its essential purpose. The entire risk out of the use of the site, the use of any products and/or services offered on or in connection with the site, and/or the use of content and/or digital downloads remains with you.

 

VIII. Maximum Liability

Notwithstanding anything else in this terms of use or posted on the site, the maximum liability that NJ FBLA is limited to any amounts actually paid to NJ FBLA by End User in any 12 month period. If you use this web site for any illegal purpose or any purpose other than that expressly permitted by these terms and conditions or otherwise in breach of these terms and conditions, you will be found liable to indemnify NJ FBLA in full for any loss, liability, or costs which NJ FBLA incurs arising from or in connection with such use or alleged use.

 

IX. Data Submission and Form Submissions

Any information collected on the site is not guaranteed as private nor does NJ FBLA guarantee the safety of your information. Any content submitted may be seen by NJ FBLA officers, directors, employees, agents, members, or affiliates and is subject to being posted on the site. Any information posted on the site, like all other information on the internet, is viewable by anyone from anywhere. You take responsibility for any trouble you or a third party may incur due to the posting of such content. You agree to provide accurate, complete, and current information when submitting content.

 

X. Access

You may not use any automatic device, program, algorithm, or methodology, or any other similar or equivalent manual process to access, acquire, copy, probe, test, or monitor any portion of the site or any content, to obtain or attempt to obtain any documents, materials, or information not purposely made available through this site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the site or any of the systems of networks comprising or connected with the site.

 

XI. Unsolicited, Obscene, and Irrelevant Email

You must understand that email addresses and forms (Collectively, “communication”) are provided for the sole purpose of communications relevant to NJ FBLA. Relevance to NJ FBLA is solely determined by the NJ FBLA Webmaster. It is a direct violation of these terms to use communication for purposes not related to NJ FBLA. You will be held liable for any damages due to the misuse of such communication methods made available on the site.

 

XII. Submission of Copyrighted Material

It is the sole responsibility of you that any content submitted by you through any means of communication made available on the site is non-copyrighted material and can be used by NJ FBLA for any purposes including but not limited to online use. Anything submitted to NJ FBLA immediately becomes the property of NJ FBLA. You agree that by submitting content that you are granting NJ FBLA a non-exclusive, perpetual, worldwide, royalty-free license to use and/or modify the submitted content for any purposes. You agree that you will not withdraw the submission of attempt to make a charge for its use. Furthermore, you warrant that you are the exclusive copyright holder of the submission and that the submission of such data is in accordance with these terms and does not violate and other person or entity’s rights.

 

XIII. Involuntary Data Collection

When visiting the site, counters or other statistical observational equipment may be used. By entering and viewing the site, you give your consent for these third party products to scan and determine information about your computer. The site may use cookies to track your internet usage.

 

XIV. Disclosing

NJ FBLA reserves the right to use or disclose your personally identifiable information for business or non-business related purposes in whatever manner desired.

 

XV. Effectiveness of Policy

This policy is effective anytime, anywhere, under any circumstances. This policy shall never be null or void due to any circumstances including but not limited to typographical errors which may be present throughout the document. This policy may be printed for your reference. For your convenience, a link to this page may be posted within all pages on this site. This document shall still be in effect in the event that a link is not specifically provided and even when the terms are made unavailable to be viewed by the public. NJ FBLA does not guarantee the visibility of these terms. The unavailability of these terms shall not restrict its jurisdiction.

 

XVI. Consent.

By the usage of any, all, or parts of this site you consent that you have read, understand, and agree to these terms and will abide by them. If changes are made to these terms, they will become in effect immediately upon creation even if they are not posted. If you disagree to abide by the entirety of these terms at all times, then immediately discontinue use of the site and exit. Otherwise, in accordance with these terms, continue.
